Swiss Living
1) Scope
These general terms and conditions apply in the version current at the time the contract is concluded for all business relationships between Swiss Living GmbH and its customers. They form an integral and supplementary component for all orders that are completed via the online shop and by telephone.
2) Registration / data protection
It is up to the customer to register for Swiss-Living.ch or to place an order without registering. In any case, the customer is obliged to provide truthful information about himself. Swiss Living reserves the right to delete customer data or to block a user name and password at any time and without giving reasons.
The data recorded will only be collected, processed and used to fulfill the obligations arising from the purchase contract and will only be used for operationally necessary purposes.
3) Offers / Private use
The listing of the range at Swiss-Living.ch alone does not constitute a legally binding offer. The presentation on the Internet is non-binding. If the customer places an order via the Internet, e-mail, mobile phone, or telephone, he makes a binding offer to conclude a purchase contract. The customer receives a confirmation that the order has been received. This confirmation does not constitute acceptance of the offer by Swiss Living. Swiss Living reserves the right to reject the application without giving reasons. A legally binding purchase contract only comes into effect when Swiss Living sends the order confirmation.
The products are always delivered according to a sample, illustration or sketch. Slight deviations in size, colour, structure and processing are reserved. Deviations without other written commitments are unavoidable, particularly in the case of follow-up/additional orders. Incorrect information/representations due to technical defects in our technical infrastructure are also reserved.
The decorative items shown in the picture are not part of the product range unless they are listed and mentioned by name. Accessories and decorative items must be purchased separately.
Unless otherwise agreed in writing, the items are intended exclusively for private use.
4) Geographical validity of our offers and prices; billing
All prices are net, including VAT.
The agreement of both parties is required for the offsetting of claims.
Our offers apply to Switzerland. For orders with delivery addresses outside of Switzerland, the stated delivery prices and flat rates are invalid.
5) Delivery times and costs
We deliver the ordered goods to the delivery address specified by the customer at the time of the order. The delivery takes place at the shipping costs shown in each individual case. These are listed before placing the order. The delivery can also be made in partial deliveries, provided these are reasonable for the customer. If partial deliveries are made at the request of Swiss Living GmbH, Swiss Living will bear the resulting additional costs.
The goods will be delivered within the specified delivery times according to the item description. Exceptions for which we cannot be responsible ourselves or which are due to the nature of the customer are excluded from this.
6) property
The goods remain the property of Swiss Living GmbH until the purchase price has been paid in full. The latter is entitled to arrange for the entry in the register of retention of title at the buyer's expense if it considers its claim to be at risk.
7) Payment
Swiss Living accepts the payment methods shown to the customer during the ordering process. The purchase price and any shipping costs incurred will be charged at the time the order is placed.
8) Complaints and Warranty
The buyer checks the goods immediately after receipt for any defects, in particular for damage to the glass. Corresponding complaints must be asserted within 8 days of receipt of the goods. Defects that become apparent later, ie during the warranty period, must be reported immediately after they are discovered.
As a rule, our articles are provided with a warranty statement directly in the product description and in the order confirmation that you receive after placing the order. If there is no such, Swiss Living grants the statutory warranty for construction and material defects from delivery of the goods to the buyer.
Excluded from the warranty are damages caused by wear and tear, aging and improper handling, as well as lamps. The warranty expires if goods are further processed or modified by the buyer despite recognizable defects.
Swiss Living GmbH or the third-party partners commissioned by it can provide the warranty either through free repairs or an equivalent replacement. Further claims are excluded.
9) Redemption and Returns
There is no right of return for furniture.
10) Copyright
The copyright to our website and its content such as graphics (non-exhaustive list) lies entirely with Swiss Living GmbH. You may not copy, download or otherwise use any part of it for your own purposes without our prior written permission.
11) Governing Law
Swiss law applies exclusively.

- guarantee
Swiss Living guarantees that any defects in the construction and material of the purchased item will be rectified. The warranty period is one year from delivery or collection
The guarantee does not apply to damage caused by wear and tear, aging, improper handling or natural color changes caused by light and other environmental influences. Swiss Living is entitled, but not obliged, to purchase a replacement for the purchased item instead of remedying the defect. Further claims of the buyer are excluded, in particular those for indirect and direct damage.
- delivery terms
The delivery conforms to the selected model. Differences in color and structure, small changes in shape, grain, fittings and dimensions as well as delays in delivery do not entitle the buyer to withdraw from the contract or to claim damages or a price reduction.
If an item is no longer produced at the factory and Swiss Living can therefore no longer deliver the purchased item, the contract is deemed to have been canceled by mutual consent of the parties. In this case, Swiss Living is only liable for the reimbursement of the payments received up to this point.
- pickups
If the purchased product is collected from Swiss Living GmbH, the buyer is obliged to check that it is complete and in perfect condition. Any notices of defects must be made on site before the goods are dismantled or loaded. Complaints made after this point in time can no longer be considered.
The buyer is responsible for ensuring that the goods he has purchased are properly dismantled and loaded. Swiss Living GmbH is not liable for damage that occurs during transport or loading of the goods.
- termination of contract
In the event that the buyer refuses to accept the purchased item or otherwise fails to fulfill the purchase contract or does not fulfill it correctly, Swiss Living GmbH is entitled to payment of a contractual penalty of 30% of the agreed purchase price, subject to proof of further damage.
Swiss Living GmbH is entitled, but not obliged, to insist on the fulfillment of the contract by the buyer instead of paying a contractual penalty. "
